Terms of Service

Welcome to Instant Flipper. These Terms of Service ("Terms") govern your access to and use of the Instant Flipper website, applications, and related services (collectively, the "Service"), operated by Instant Flipper ("we", "us", "our"). By using the Service you agree to these Terms.

1. What Instant Flipper is

Instant Flipper is a web application that helps furniture flippers evaluate potential purchases, plan restorations, generate marketplace listings, and track projects. It uses artificial intelligence to analyze photos and short videos you upload, suggest restoration directions, estimate resale value ranges from public listing data, and produce reference renderings.

2. Accounts and anonymous trial sessions

• You may try limited functionality without creating an account through an anonymous trial session. Anonymous sessions are tied to your browser or device and may be lost if you clear storage or switch devices.
• To keep your data and unlock full functionality you must create an account. You are responsible for the accuracy of the information you provide and for maintaining the confidentiality of your credentials.
• You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account.

3. Founders Access purchase

• Founders Access is a one-time purchase of $199 USD that grants lifetime access to the features included in the Instant Flipper Workshop as they exist at the time of purchase, together with future updates to those features at our discretion.
• AI-powered features (scans, coaching, listing generation, rendering) are subject to monthly AI usage quotas. Quotas, model providers, and feature scopes may evolve over time as we tune costs and quality. Reasonable notice will be provided for material reductions.
• "Lifetime" means the operational lifetime of the Service. We do not guarantee that the Service will be available indefinitely.
• Refunds are governed by our Refund Policy.

4. Acceptable use

You agree not to:

• Use the Service to violate any law or third-party rights.
• Upload content you do not have the right to upload, or content depicting other people without their consent.
• Attempt to reverse engineer, resell, scrape, or automate access to the Service outside of documented interfaces.
• Abuse AI features (e.g., scripted or bulk requests) or attempt to bypass usage quotas.
• Use the Service to generate content that is unlawful, harmful, or infringing.

5. AI-generated content disclaimer

Value estimates, flip recommendations, restoration plans, buy/sell verdicts, and rendered images produced by the Service are informational estimates generated by AI models using photos you provide and public listing data. They are not appraisals, professional advice, or guarantees of resale value, sale speed, or profit.

• You remain solely responsible for every purchase, restoration, and sale decision you make.
• Furniture restoration can involve chemicals, power tools, heavy items, and biological hazards (pests, mold, contaminated upholstery). You are responsible for your own safety, protective equipment, and compliance with local regulations.
• Renderings are illustrative concepts, not photographs of your item after restoration.

6. Your content

You retain ownership of the photos, videos, and project data you upload ("Your Content"). You grant us a limited, worldwide, non-exclusive license to store, process, transmit, and display Your Content solely to operate and improve the Service, including sending it to third-party AI providers for analysis and rendering as described in our Privacy Policy.

7. Our intellectual property

The Service, including the Instant Flipper name, logo, playbooks, methodology, code, and UI, is owned by us and protected by intellectual property laws. Except for the limited license to use the Service granted by these Terms, no rights are transferred to you.

8. Third-party services

The Service integrates third-party services (payment processing, AI model providers, transactional email, marketplace price data, analytics). Your use of the Service is also subject to those providers' terms where applicable. We are not responsible for third-party outages or errors.

9. Termination

• You may stop using the Service and delete your account at any time.
• We may suspend or terminate accounts that violate these Terms, abuse AI quotas, initiate chargebacks, or create risk for the Service or other users. Where practical, we will provide notice and an opportunity to cure.
• Termination for cause does not entitle you to a refund except as required by law or expressly stated in our Refund Policy.

10. Disclaimer of warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that AI outputs will be accurate.

11. Limitation of liability

To the maximum extent permitted by law, in no event will Instant Flipper, its owners, or its affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Service, even if advised of the possibility. Our aggregate liability for any claim arising out of the Service shall not exceed the greater of (a) the amount you paid us in the twelve months preceding the claim, or (b) one hundred dollars ($100 USD).

12. Indemnification

You agree to indemnify and hold Instant Flipper harmless from any claims, damages, or expenses arising out of your use of the Service, Your Content, or your violation of these Terms or any law.

13. Changes to the Service and Terms

We may update the Service, features, quotas, and these Terms from time to time. Material changes will be communicated by updating the "Last updated" date and, where appropriate, by email or in-app notice. Continued use after changes take effect constitutes acceptance.

14. Governing law

Any dispute shall be resolved in the state or federal courts located in Maricopa County, Arizona, and you consent to their exclusive jurisdiction and venue. If you are a consumer resident of a jurisdiction that provides you with non-waivable rights, this section does not override those rights.
